ONE YEAR LIMITED WARRANTY, DISCLAIMER OF WARRANTIES & LIMITATION OF LIABILITY

Easy Preparedness LLC (“Company”) warrants to the original purchaser that the product(s) are free from defects in workmanship and materials for one (1) year from the date of purchase. Any product found to be defective after examination by Company will be replaced or repaired, at Company’s discretion, provided: (i) the defect arose during the one (1) year warranty period; (ii) the defect is deemed by Company to have been the result from original workmanship or materials and not the result of use or misuse by purchaser and (iii) the claim is made no later than 10 days following the expiration of the one year warranty period. Proof of purchase is necessary for any claim made under this limited warranty. Purchaser shall bear the shipping costs to remit any product back to Company for a claim under this warranty. This warranty applies only to the original purchaser and is not transferable. This warranty does not cover any other damage, loss of use, expenses, liabilities, costs or other elements not expressly covered herein. Without limiting the forgoing sentence, this warranty expressly does not apply to losses, costs, expenses, liabilities or damage caused by neglect, accident, abuse, unreasonable use/misuse, commercial use, improper operation, acts of God or any other type of use of the product.

Easy Preparedness LLC is expressly not responsible for any use of the product(s) by purchaser or any third party(ies), with purchaser being fully responsible for the safe use of the product(s). Customer further assumes responsibility for any use of the product(s) by any third party(ies). Purchaser will indemnify and hold Company harmless from any claims, demands, losses, liabilities, damages, attorney fees, other obligations or expenses incurred by Company which arise in any way from purchaser’s use of the product(s) or from any purchaser acts or omissions with respect to any product(s) sold to purchaser from Company.

EASY PREPAREDNESS LLC DISCLAIMS ALL RESPONSIBILITY FOR INCIDENTAL, SPECIAL, CONSEQUENTIAL OR COMMERCIAL LOSSES CAUSED BY THE USE OF THIS PRODUCT(S). The forgoing limitation is not allowed in some states so this disclaimer may not apply to you. Company shall not be liable for any direct, punitive, special or indirect damages that result or may be claimed to have resulted from the use of, or the inability to use, the product(s). All claims you may have in relation to the purchase of products sold by Company must be commenced within one (1) year after the cause of action or claim arises. The courts of the state of Utah shall have exclusive jurisdiction over all claims relating to products sold by Company. Such claims shall be determined by Utah law without regard to conflict of law principles. The parties agree that the venue is appropriate in the courts of Salt Lake County, Utah. You have specific legal rights with this warranty. Depending on the state you may also have other rights. To fully understand your rights, you should consult the laws of your state.

EASY PREPAREDNESS LLC SPECIFICALLY DISCLAIMS, TO THE FULLEST EXTENT PERMITTED UNDER LAW, ALL STATUTORY AND IMPLIED WARRANTIES INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A SPECIFIC PURPOSE AS WELL AS AGAINST HIDDEN OR LATENT DEFECTS. TO THE EXTENT SUCH WARRANTIES CANNOT BE DISCLAIMED, COMPANY LIMITS THE DURATION AND REMEDIES OF SUCH WARRANTIES TO THE DURATION OF THIS LIMITED WARRANTY AND SUBJECT ALSO TO THE REMEDIES SET FORTH HEREIN. SOME STATES DO NOT FULLY ALLOW THE FORGOING, TO FULLY UNDERSTAND YOUR RIGHTS, YOU SHOULD CONSULT THE LAWS OF YOUR STATE. TO THE EXTENT PERMITTED BY LAW, THIS LIMITED WARRANTY AND THE REMEDIES SET FORTH HEREIN ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL, WRITTEN STATUTORY, EXPRESS OR IMPLIED. THE MAXIMUM LIABILITY TO EASY PREPAREDNESS LLC FOR ANY TYPE OF CLAIM, WHETHER IN WARRANTY, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER CAUSE OF ACTION RELATING TO THE PRODUCT(S) WILL IN NO CASE EXCEED THE PURCHASE PRICE OF THE PRODUCT(S) GIVING RISE TO THE CLAIM.
